An independent judiciary is essential to a free and democratic society based on the rule of law. Since the Charter of Rights and Freedoms became part of the Constitution in 1982, the role of the judiciary has become even more important. The courts effectively make public policy when they interpret the Charter. Because of this, the temptation for politicians to try to influence future judgments by choosing like-minded judges is greater today.
